5. Recruitment Services Disclaimer:

Give & Grow Recruitment Agency acts as an intermediary between job seekers and employers. Submission of a CV or application does not guarantee employment. Give & Grow does not guarantee availability of roles, response times, interview requests, or job offers. Employment decisions remain solely with the client. Give & Grow will not be liable for outcomes of any employment relationship, including job suitability, remuneration disputes, contract terms, misconduct, or termination after placement. The user acknowledges that the agency may decline to work with any party at its discretion.

6. Independent Contractors:

Recruiters and sales representatives operate strictly as independent contractors and not as employees of Give & Grow. The website may invite users to apply as recruiters. Acceptance is not guaranteed. Contractors are responsible for their own tax, insurance, equipment, internet, and compliance with relevant laws. Give & Grow is not responsible for contractor performance, loss, negligence, or any representations made by contractors to clients or job seekers. Contractors who access internal documents, training material, or confidential data agree to treat such information as strictly confidential and may face legal action for any breach.

7. Foundation Purpose and Limitations:

The Give & Grow Foundation operates independently from the recruitment agency. It exists to create access to education support, matric completion, further studies, and employment opportunities. The Foundation does not guarantee funding or sponsorship for any individual. Donors contribute voluntarily and without expectation of return, control, or personal benefit. Give & Grow reserves the right to accept or decline donations and sponsorships at its discretion. Allocation of funds, support projects, and beneficiaries is determined solely by the Foundation’s internal policies and compliance obligations.

8. Donation Terms:

All donations made through the website are voluntary. Donors confirm that funds are lawful and given without the expectation of direct personal benefit. Donations may be allocated to various programs depending on priority and availability. Where applicable, donors may request acknowledgement letters; however, issuance of tax-deductible certificates depends on South African Revenue Service requirements and the Foundation’s compliance status as an NPC or NPO. Give & Grow is not responsible for donor misunderstanding of tax legislation. Donations are generally non-refundable unless required by law.

9. No Financial or Legal Advice:

The website does not provide legal, tax, financial, or professional advice. Users should consult qualified professionals before relying on any information. Give & Grow is not liable for decisions or actions taken based on any content displayed on the website.

10. Privacy and Data:

The website may store and process personal information submitted through forms, applications, CVs, or donation portals. Personal information will be treated in accordance with South African POPIA requirements and relevant international standards where applicable. Give & Grow will take reasonable measures to protect the data but cannot guarantee absolute security. Users submit information at their own risk. Give & Grow will not be liable for unauthorized access, breaches, or interception unless due to gross negligence.

11. User Responsibilities:

Users agree to provide accurate information when submitting CVs, applications, forms, or donations. Users must not impersonate another individual or misrepresent their credentials, qualifications, or legal status. Employers must provide accurate job descriptions and lawful employment opportunities. Recruiters must follow internal guidelines and refrain from making promises, guarantees, or commitments on behalf of Give & Grow without written authorization.

12. Intellectual Property:

All content on the website, including text, logos, images, layout, documentation, training materials, and digital resources, remains the intellectual property of Give & Grow unless stated otherwise. Users may not copy, reproduce, distribute, or use content for commercial purposes without written consent. Unauthorized use may result in legal action.

13. Third-Party Links:

The website may contain links to third-party websites or integrated services such as payment gateways, job posting platforms, or social media feeds. Give & Grow is not responsible for the content, policies, safety, practices, or reliability of any third-party site. Users access third-party services at their own risk.

14. Limitation of Liability:

Give & Grow will not be responsible for any direct, indirect, incidental, special, consequential, or punitive damages arising from use of the website, services, recruitment outcomes, donation activities, system failures, data loss, unauthorized access, or interruption of operations. Give & Grow does not guarantee uninterrupted availability of the website. Use of the website is entirely at the user’s risk.

15. Indemnity:

Users agree to indemnify and hold harmless Give & Grow, its owners, directors, contractors, partners, affiliates, and staff from any claims, liabilities, damages, losses, or expenses resulting from misuse of the website, violation of these Terms and Conditions, provision of false information, breach of laws, or infringement of third-party rights.

17. Foundation Compliance:

The Give & Grow Foundation may be registered as an NPO or NPC for regulatory and tax compliance purposes. Users acknowledge that benefits such as Section 18A tax certificates are subject to legal approval and cannot be guaranteed. Programs, sponsorships, and beneficiary support are allocated in line with compliance obligations and internal governance procedures.

19. Governing Law and Jurisdiction:
